How Detroit’s bankruptcy filing will have national repercussions


Back when I was a rookie reporter at the Detroit Free Press nearly 30 years ago, the big debate the staff had over lunches was which would go bankrupt first: the big automakers or the city. And which experience would be worse.

You could make arguments for each possibility, but most of the staffers thought there was no way either event would ever actually happen. They insisted that the early signs of trouble were an anomaly or something that could be reversed before it became a calamity.
Having just earned my degree in economics, I thought back then that both were possible — many years in the future — and that bankruptcies for the Big Three would be bad for the city, but that a bankruptcy for the city would be bad for the entire country.
Sadly, what was once little more than a theory is now a reality, but what’s worse is that so many people — like my old colleagues — don’t recognize what the city’s financial woes mean on a national level.
Detroit owes roughly $20 billion to over 100,000 creditors, but the big creditors people will be watching are the city’s public-sector labor unions, which fear that a bankruptcy judge might let the city reduce or cancel pensions and retiree health benefits.
Sure, the unions have the law on their side — Michigan’s state constitution protects workers’ pensions from being reduced — but they still have reason to be worried. After all, Michigan law also requires public pensions to be fully funded every year, and yet Detroit apparently only managed that using accounting tricks that, by some estimates, have left the city as much as $3.5 billion off the mark.
That’s why the Detroit bankruptcy filing serves as a warning beacon for everyone expecting a pension and other benefits when they retire, a signal that it’s dangerous to entrust your financial future to others, assuming they are going to keep their promises.
How much precedent Detroit will set for other communities remains to be seen, but clearly everyone is watching to see what’ll be allowed. Other communities on the brink will see how the Motor City comes through the experience financially and decide if they want to mark a similar course on the map, even if it is as a last resort.
There is plenty of precedent for corporations using bankruptcy to cut or eliminate pension obligations — Delta Airlines DAL +1.96%   being the most-recent big-name company to go that route — leaving the Pension Benefit Guaranty Corp. to step in with smaller pensions and the workers with a much less secure future.
The Pew Center for the States estimates that public pension plans nationwide were underfunded by $1.4 trillion in 2010. While the stock market has reached record highs — narrowing the gap somewhat — since then, the undeniable problem is that most state and local government pension funds don’t have enough money to live up to the promises they have made.
If employers can’t live up to their obligations, you can bet that the Pension Benefit Guaranty Corp. — the nation’s pension backstop — will follow suit and run out of money too.
Even if the Detroit situation is resolved without setting some benchmark for other troubled municipalities to use and follow, the nation’s pension shortfalls aren’t going away; this story is going to play out again and again, and while it will be corporations, cities and towns in the headlines, it will be the nameless, faceless individuals who are the real story.
That’s not a story anyone wants playing out in their own home.
Now, back to the bankruptcy filings of the big automakers for a moment. They were big stories for Detroit, but they actually showed the underlying values of the businesses; allowed a break and a chance to restructure, they were able to improve their fortunes and move forward. Talk to auto-industry analysts and some of them are more bullish on the prospects of the domestic manufacturers than they have been in decades.

The problem for the city of Detroit, by comparison, is that there is no reason to believe it comes through a bankruptcy with greatly improved prospects. The court process will be more a respite than a solution; the city will still have the same high unemployment, dwindling work force and Rust Belt economics, with the same delinquent tax revenue collections and other conditions that make it hard to see any ability to improve the long-term numbers without reducing pensions or eliminating benefits.
Even during those conversations at the Free Press in the 1980s, colleagues who had seen the city and the automakers take care of generations of workers wondered if my worries about future bankruptcy meant that workers should not trust their pensions.
“Oh, they will get pension payments,” I said, “but maybe not of the size they expect, so the more they save now — rather than living as if they’re set and taken care of because that’s what the company or union says — the more secure they will be.”
That advice holds for anyone with a pension today: Take full responsibility for your future savings, or supplement the benefits you are earning now, just in case.
Anything less than that, and you have underfunded your future.
Companies and communities can get away with underfunding their futures, to some extent. Accounting rules, revenue projections and, well, bankruptcy courts have allowed it to this point, even as the numbers have become increasingly scary.
Individuals don’t have the same luxury.
If you don’t save enough — and if your pension benefits are cut because of the recklessness of your past employers — no one is going to bail you out. That’s what investors need to think about every time they hear about how Detroit’s bankruptcy is proceeding; trouble is going to show up, even if it takes a few decades to hit your home. Instead of crossing your fingers and hoping that you won’t be effected, make a plan.

Faster, Smoother, More Responsive


Android 4.3 builds on the performance improvements already included in Jelly Bean — vsync timingtriple bufferingreduced touch latencyCPU input boost, andhardware-accelerated 2D rendering — and adds new optimizations that make Android even faster.
For a graphics performance boost, the hardware-accelerated 2D renderer now optimizes the stream of drawing commands, transforming it into a more efficient GPU format by rearranging and merging draw operations. For multithreaded processing, the renderer can also now use multithreading across multiple CPU cores to perform certain tasks.
Android 4.3 also improves rendering for shapes and text. Shapes such as circles and rounded rectangles are now rendered at higher quality in a more efficient manner. Optimizations for text include increased performance when using multiple fonts or complex glyph sets (CJK), higher rendering quality when scaling text, and faster rendering of drop shadows.
Improved window buffer allocation results in a faster image buffer allocation for your apps, reducing the time taken to start rendering when you create a window.
For highest-performance graphics, Android 4.3 introduces support for OpenGL ES 3.0 and makes it accessible to apps through both framework and native APIs. On supported devices, the hardware accelerated 2D rendering engine takes advantage of OpenGL ES 3.0 to optimize texture management and increase gradient rendering fidelity.

OpenGL ES 3.0 for High-Performance Graphics


Android 4.3 introduces platform support for Khronos OpenGL ES 3.0, providing games and other apps with highest-performance 2D and 3D graphics capabilities on supported devices. You can take advantage of OpenGL ES 3.0 and related EGL extensions using either framework APIs or native API bindings through the Android Native Development Kit (NDK).
Key new functionality provided in OpenGL ES 3.0 includes acceleration of advanced visual effects, high quality ETC2/EAC texture compression as a standard feature, a new version of the GLSL ES shading language with integer and 32-bit floating point support, advanced texture rendering, and standardized texture size and render-buffer formats.
You can use the OpenGL ES 3.0 APIs to create highly complex, highly efficient graphics that run across a range of compatible Android devices, and you can support a single, standard texture-compression format across those devices.
OpenGL ES 3.0 is an optional feature that depends on underlying graphics hardware. Support is already available on Nexus 7 (2013), Nexus 4, and Nexus 10 devices.

Enhanced Bluetooth Connectivity

Now you can design and build apps that interact with the latest generation of small, low-power devices and sensors that use Bluetooth Smart technology.
Android 4.3 gives you a single, standard API for interacting with Bluetooth Smart devices.
Android 4.3 introduces built-in platform support for Bluetooth Smart Ready in the central role and provides a standard set of APIs that apps can use to discover nearby devices, query for GATT services, and read/write characteristics.
With the new APIs, your apps can efficiently scan for devices and services of interest. For each device, you can check for supported GATT services by UUID and manage connections by device ID and signal strength. You can connect to a GATT server hosted on the device and read or write characteristics, or register a listener to receive notifications whenever those characteristics change.
You can implement support for any GATT profile. You can read or write standard characteristics or add support for custom characteristics as needed. Your app can function as either client or server and can transmit and receive data in either mode. The APIs are generic, so you’ll be able to support interactions with a variety of devices such as proximity tags, watches, fitness meters, game controllers, remote controls, health devices, and more.
Support for Bluetooth Smart Ready is already available on Nexus 7 (2013) and Nexus 4 devices and will be supported in a growing number of Android-compatible devices in the months ahead.

AVRCP 1.3 Profile

Android 4.3 adds built-in support for Bluetooth AVRCP 1.3, so your apps can support richer interactions with remote streaming media devices. Apps such as media players can take advantage of AVRCP 1.3 through the remote control client APIs introduced in Android 4.0. In addition to exposing playback controls on the remote devices connected over Bluetooth, apps can now transmit metadata such as track name, composer, and other types of media metadata.
Platform support for AVRCP 1.3 is built on the Bluedroid Bluetooth stack introduced by Google and Broadcom in Android 4.2. Support is available right away on Nexus devices and other Android-compatible devices that offer A2DP/AVRCP capability.

Support for Restricted Profiles

A tablet owner can set up one or more restricted profiles in Settings and manage them independently.

Your app can offer restrictions to let owners manage your app content when it's running in a profile.
Android 4.3 extends the multiuser feature for tablets withrestricted profiles, a new way to manage users and their capabilities on a single device. With restricted profiles, tablet owners can quickly set up separate environments for each user, with the ability to manage finer-grained restrictions in the apps that are available in those environments. Restricted profiles are ideal for friends and family, guest users, kiosks, point-of-sale devices, and more.
Each restricted profile offers an isolated and secure space with its own local storage, home screens, widgets, and settings. Unlike with users, profiles are created from the tablet owner’s environment, based on the owner’s installed apps and system accounts. The owner controls which installed apps are enabled in the new profile, and access to the owner’s accounts is disabled by default.
Apps that need to access the owner’s accounts — for sign-in, preferences, or other uses — can opt-in by declaring a manifest attribute, and the owner can review and manage those apps from the profile configuration settings.
For developers, restricted profiles offer a new way to deliver more value and control to your users. You can implement app restrictions — content or capabilities controls that are supported by your app — and advertise them to tablet owners in the profile configuration settings.
You can add app restrictions directly to the profile configuration settings using predefined boolean, select, and multi-select types. If you want more flexibility, you can even launch your own UI from profile configuration settings to offer any type of restriction you want.
When your app runs in a profile, it can check for any restrictions configured by the owner and enforce them appropriately. For example, a media app might offer a restriction to let the owner set a maturity level for the profile. At run time, the app could check for the maturity setting and then manage content according to the preferred maturity level.
If your app is not designed for use in restricted profiles, you can opt out altogether, so that your app can't be enabled in any restricted profile.

Optimized Location and Sensor Capabilities


Google Play services offers advanced location APIs that you can use in your apps. Android 4.3 optimizes these APIs on supported devices with new hardware and software capabilities that minimize use of the battery.
Hardware geofencing optimizes for power efficiency by performing location computation in the device hardware, rather than in software. On devices that support hardware geofencing, Google Play services geofence APIs will be able to take advantage of this optimization to save battery while the device is moving.
Wi-Fi scan-only mode is a new platform optimization that lets users keep Wi-Fi scan on without connecting to a Wi-Fi network, to improve location accuracy while conserving battery. Apps that depend on Wi-Fi for location services can now ask users to enable scan-only mode from Wi-Fi advanced settings. Wi-Fi scan-only mode is not dependent on device hardware and is available as part of the Android 4.3 platform.
New sensor types allow apps to better manage sensor readings. A game rotation vector lets game developers sense the device’s rotation without having to worry about magnetic interference. Uncalibrated gyroscope and uncalibrated magnetometer sensors report raw measurements as well as estimated biases to apps.
The new hardware capabilities are already available on Nexus 7 (2013) and Nexus 4 devices, and any device manufacturer or chipset vendor can build them into their devices.

New Media Capabilities


Modular DRM framework

To meet the needs of the next generation of media services, Android 4.3 introduces a modular DRM framework that enables media application developers to more easily integrate DRM into their own streaming protocols, such as MPEG DASH (Dynamic Adaptive Streaming over HTTP, ISO/IEC 23009-1).
Through a combination of new APIs and enhancements to existing APIs, the media DRM framework provides anintegrated set of services for managing licensing and provisioning, accessing low-level codecs, and decoding encrypted media data. A new MediaExtractor API lets you get the PSSH metadata for DASH media. Apps using the media DRM framework manage the network communication with a license server and handle the streaming of encrypted data from a content library.

VP8 encoder

Android 4.3 introduces built-in support for VP8 encoding, accessible from framework and native APIs. For apps using native APIs, the platform includes OpenMAX 1.1.2 extension headers to support VP8 profiles and levels. VP8 encoding support includes settings for target bitrate, rate control, frame rate, token partitioning, error resilience, reconstruction and loop filters. The platform API introduces VP8 encoder support in a range of formats, so you can take advantage of the best format for your content.
VP8 encoding is available in software on all compatible devices running Android 4.3. For highest performance, the platform also supports hardware-accelerated VP8 encoding on capable devices.

Video encoding from a surface

Starting in Android 4.3 you can use a surface as the input to a video encoder. For example, you can now direct a stream from an OpenGL ES surface to the encoder, rather than having to copy between buffers.

Media muxer

Apps can use new media muxer APIs to combine elementary audio and video streams into a single output file. Currently apps can multiplex a single MPEG-4 audio stream and a single MPEG-4 video stream into a single MPEG-4 ouput file. The new APIs are a counterpart to the media demuxing APIs introduced in Android 4.2.

Playback progress and scrubbing in remote control clients

Since Android 4.0, media players and similar applications have been able to offer playback controls from remote control clients such as the device lock screen, notifications, and remote devices connected over Bluetooth. Starting in Android 4.3, those applications can now also expose playback progress and speed through their remote control clients, and receive commands to jump to a specific playback position.

New Ways to Build Beautiful Apps


Access to notifications

Notifications have long been a popular Android feature because they let users see information and updates from across the system, all in one place. Now in Android 4.3, apps can observe the stream of notifications with the user's permission and display the notifications in any way they want, including sending them to nearby devices connected over Bluetooth.
You can access notifications through new APIs that let you register a notification listener service and with permission of the user, receive notifications as they are displayed in the status bar. Notifications are delivered to you in full, with all details on the originating app, the post time, the content view and style, and priority. You can evaluate fields of interest in the notifications, process or add context from your app, and route them for display in any way you choose.
The new API gives you callbacks when a notification is added, updated, and removed (either because the user dismissed it or the originating app withdrew it). You'll be able to launch any intents attached to the notification or its actions, as well as dismiss it from the system, allowing your app to provide a complete user interface to notifications.
Users remain in control of which apps can receive notifications. At any time, they can look in Settings to see which apps have notification access and enable or disable access as needed. Notification access is disabled by default — apps can use a new Intent to take the user directly to the Settings to enable the listener service after installation.

View overlays

You can now create transparent overlays on top of Views and ViewGroups to render a temporary View hierarchy or transient animation effects without disturbing the underlying layout hierarchy. Overlays are particularly useful when you want to create animations such as sliding a view outside of its container or dragging items on the screen without affecting the view hierarchy.

Optical bounds layout mode

A new layout mode lets you manage the positioning of Views inside ViewGroups according to their optical bounds, rather than their clip bounds. Clip bounds represent a widget’s actual outer boundary, while the new optical bounds describe the where the widget appears to be, within the clip bounds. You can use the optical bounds layout mode to properly align widgets that use outer visual effects such as shadows and glows.

Custom rotation animation types

Apps can now define the exit and entry animation types used on a window when the device is rotated. You can set window properties to enable jump-cutcross-fade, or standard window rotation. The system uses the custom animation types when the window is fullscreen and is not covered by other windows.

Screen orientation modes

Apps can set new orientation modes for Activities to ensure that they are displayed in the proper orientation when the device is flipped. Additionally, apps can use a new mode to lock the screen to its current orientation. This is useful for apps using the camera that want to disable rotation while shooting video.

Intent for handling Quick Responses

Android 4.3 introduces a new public Intent that lets any app handle Quick Responses — text messages sent by the user in response to an incoming call, without needing to pick up the call or unlock the device. Your app can listen for the intent and send the message to the caller over your messaging system. The intent includes the recipient (caller) as well as the message itself.

Support for International Users


 
More parts of Android 4.3 are optimized for RTL languages.

RTL improvements

Android 4.3 includes RTL performance enhancements and broader RTL support across framework UI widgets, including ProgressBar/Spinner and ExpandableListView. More debugging information visible through the uiautomatorviewer tool. In addition, more system UI components are now RTL aware, such as notifications, navigation bar and the Action Bar.
To provide a better systemwide experience in RTL scripts, more default system apps now support RTL layouts, including Launcher, Quick Settings, Phone, People, SetupWizard, Clock, Downloads, and more.

Utilities for localization

Pseudo-locales make it easier to test your app's localization.
Android 4.3 also includes new utilities and APIs for creating better RTL strings and testing your localized UIs. A new BidiFormatter provides a set of simple APIs for wrapping Unicode strings so that you can fine-tune your text rendering in RTL scripts. To let you use this utility more broadly in your apps, the BidiFormatter APIs are also now available for earlier platform versions through the Support Package in the Android SDK.
To assist you with managing date formatting across locales, Android 4.3 includes a new getBestDateTimePattern() method that automatically generates the best possible localized form of a Unicode UTS date for a locale that you specify. It’s a convenient way to provide a more localized experience for your users.
To help you test your app more easily in other locales, Android 4.3 introduces pseudo-locales as a new developer option. Pseudo-locales simulate the language, script, and display characteristics associated with a locale or language group. Currently, you can test with a pseudo-locale for Accented English, which lets you see how your UI works with script accents and characters used in a variety of European languages.

Accessibility and UI Automation


Starting in Android 4.3, accessibility services can observe and filter key events, such as to handle keyboard shortcuts or provide navigation parity with gesture-based input. The service receives the events and can process them as needed before they are passed to the system or other installed apps.
Accessibility services can declare new capability attributes to describe what their services can do and what platform features they use. For example, they can declare the capability to filter key events, retrieve window content, enable explore-by-touch, or enable web accessibility features. In some cases, services must declare a capability attribute before they can access related platform features. The system uses the service’s capability attributes to generate an opt-in dialog for users, so they can see and agree to the capabilities before launch.
Building on the accessibility framework in Android 4.3, a new UI automation framework lets tests interact with the device’s UI by simulating user actions and introspecting the screen content. Through the UI automation framework you can perform basic operations, set rotation of the screen, generate input events, take screenshots, and much more. It’s a powerful way to automate testing in realistic user scenarios, including actions or sequences that span multiple apps.

Enterprise and Security


Wi-Fi configuration for WPA2-Enterprise networks

Apps can now configure the Wi-Fi credentials they need for connections to WPA2 enterprise access points. Developers can use new APIs to configure Extensible Authentication Protocol (EAP) and Encapsulated EAP (Phase 2) credentials for authentication methods used in the enterprise. Apps with permission to access and change Wi-Fi can configure authentication credentials for a variety of EAP and Phase 2 authentication methods.

Android sandbox reinforced with SELinux

Android now uses SELinux, a mandatory access control (MAC) system in the Linux kernel to augment the UID based application sandbox. This protects the operating system against potential security vulnerabilities.

KeyChain enhancements

The KeyChain API now provides a method that allows applications to confirm that system-wide keys are bound to ahardware root of trust for the device. This provides a place to create or store private keys that cannot be exported off the device, even in the event of a root or kernel compromise.

Android Keystore Provider

Android 4.3 introduces a keystore provider and APIs that allow applications to create exclusive-use keys. Using the APIs, apps can create or store private keys that cannot be seen or used by other apps, and can be added to the keystore without any user interaction.
The keystore provider provides the same security benefits that the KeyChain API provides for system-wide credentials, such as binding credentials to a device. Private keys in the keystore cannot be exported off the device.

Restrict Setuid from Android Apps

The /system partition is now mounted nosuid for zygote-spawned processes, preventing Android applications from executing setuid programs. This reduces root attack surface and likelihood of potential security vulnerabilities.

New Ways to Analyze Performance


Systrace uses a new command syntax and lets you collect more types of profiling data.

Enhanced Systrace logging

Android 4.3 supports an enhanced version of theSystrace tool that’s easier to use and that gives you access to more types of information to profile the performance of your app. You can now collect trace data from hardware moduleskernel functions,Dalvik VM including garbage collection, resources loading, and more.
Android 4.3 also includes new Trace APIs that you can use in your apps to mark specific sections of code to trace using Systrace begin/end events. When the marked sections of code execute, the system writes the begin/end events to the trace log. There's minimal impact on the performance of your app, so timings reported give you an accurate view of what your app is doing.
You can visualize app-specific events in a timeline in the Systrace output file and analyze the events in the context of other kernel and user space trace data. Together with existing Systrace tags, custom app sections can give you new ways to understand the performance and behavior of your apps.

On-screen GPU profiling

Android 4.3 adds new developer options to help you analyze your app’s performance and pinpoint rendering issues on any device or emulator.
In the Profile GPU rendering option you can now visualize your app’s effective framerate on-screen, while the app is running. You can choose to display profiling data as on-screen bar or line graphs, with colors indicating time spent creating drawing commands (blue), issuing the commands (orange), and waiting for the commands to complete (yellow). The system updates the on-screen graphs continuously, displaying a graph for each visible Activity, including the navigation bar and notification bar.
A green line highlights the 60ms threshold for rendering operations, so you can assess the your app’s effective framerate relative to a 60 fps goal. If you see operations that cross the green line, you can analyze them further using Systrace and other tools.
On devices running Android 4.2 and higher, developer options are hidden by default. You can reveal them at any time by tapping 7 times on Settings > About phone > Build number on any compatible Android device.

StrictMode warning for file URIs

The latest addition to the StrictMode tool is a policy constraint that warns when your app exposes a file:// URI to the system or another app. In some cases the receiving app may not have access to the file:// URI path, so when sharing files between apps, a content:// URI should be used (with the appropriate permission). This new policy helps you catch and fix such cases. If you’re looking for a convenient way to store and expose files to other apps, try using theFileProvider content provider that’s available in the Support Library.

Après de fortes croissances sur ces vingt dernières années, l’âge d’or de l’immobilier belge touche probablement à sa fin. C’est du moins ce qu’affirme une étude de la banque ING qui table sur "une correction de 15 %" du prix moyen des biens immobiliers belges d’ici 2017. Si pour cette année, ING espère encore une faible hausse de prix (surtout sur les appartements et davantage en Wallonie qu’en Flandre), une stagnation est prévue en 2014, avant une baisse conséquente des prix durant les trois années suivantes. "Ce n’est pas un crash, ni une bulle qui explose, mais l’adaptation du marché au pouvoir d’achat des Belges. En fait, cela va nous ramener aux prix de 2009 , nuance Julien Manceaux, économiste chez ING. La chute ne sera pas brutale, mais étalée sur plusieurs années."
Différents éléments expliquent ce recul, dont le principal est "le grand choc du pouvoir d’achat des Belges" , prévu dès la fin de l’année prochaine. Explications.
1. Les taux d’intérêts vont augmenter. Les taux hypothécaires (actuellement de 3, 6 % sur les taux fixes à plus de dix ans) sont historiquement bas. Dans quelques mois, ce sera du passé. "C’est quasiment une certitude" , reprend Julien Manceaux, pour qui cela ne semble "pas fou" de tabler sur une hausse de 150 points de base (soit 1,5 % supplémentaire) dans les quatre prochaines années. Pour information, un emprunteur qui a une mensualité de 800 euros avec un taux de 3,6 % voit celle-ci monter à 900 euros si le taux passe à 4,6 %. Soit une perte de pouvoir d’achat de 9 %. Pourquoi cette hausse est-elle inévitable ? Il y a tout d’abord les régulations européennes (Bâle III) qui vont obliger dès 2014 les banques de garder en réserve davantage de capital qu’auparavant pour garantir leurs prêts. "Cela a évidemment un coût pour les banques, qui vont forcément le répercuter sur leurs clients." La politique monétaire européenne va également pousser les taux courts vers le haut, une fois le retour plus affirmatif de la reprise économique et de l’inflation dans la zone euro (sans doute vers 2015).
2. Le Belge est de plus en plus serré dans son emprunt hypothécaire. D’après l’économiste, l’accès au marché immobilier n’a jamais été aussi compliqué que depuis les années 90. En fait, la situation n’a fait que se détériorer ces dernières années : l’écart s’est ainsi creusé entre la courbe des revenus et celle des prix, surtout depuis le début des années 2000. Les Belges doivent de plus en plus s’endetter pour pouvoir avoir accès à la propriété. De moins de 40 % du PIB en 2008, les engagements hypothécaires sont passés à près de 46 % fin 2012. "Cet endettement est l’un des facteurs à l’origine de la hausse des ratios prix-revenus" , poursuit l’économiste. A titre d’exemple, il faut dorénavant près de quatorze ans de revenus déclarés pour s’offrir une maison à Bruxelles, alors que ce chiffre n’était que de quatre ans et demi en 1995. Ce ratio a plus que doublé dans la majorité des cas. Dans le Brabant wallon, six années de revenus complets sont nécessaires pour s’acheter un appartement contre trois années en 1995. "Il faut une croissance de l’endettement plus en ligne avec les fondamentaux économiques" , plaide M. Manceaux.
3. L’épargne historique belge ne contrera pas cet effet. Jusqu’ici beaucoup de Belges avaient trouvé la parade en apportant davantage d’épargne propre vers l’immobilier, un phénomène favorisé par des changements fiscaux (lois sur les donations, DLU,…). Il faut dire que la Belgique dispose en terme de PIB du premier stock d’épargne européen et que cet apport propre atteint actuellement 40 % du prix des transactions immobilières. Mais ce chiffre est un peu tronqué, d’après Julien Manceaux. "L’épargne est très mal répartie en Belgique." Si certains peuvent ainsi payer un bien, uniquement via fonds propres une majorité de Belges sont obligés de passer par la casse "Banque". De plus, "cet apport d’épargne ne peut pas croître suffisamment vite pour contrer l’entièreté du choc du pouvoir d’achat en Belgique" . Les raisons ? Les Belges vivent ainsi plus longtemps et "mangent" davantage leur épargne, tandis qu’un regain d’intérêt pour les marchés boursiers se confirme, et ce au détriment de l’immobilier.
4. Durcissement de la fiscalité. L’immobilier pourrait devenir moins intéressant fiscalement. Il y a de très fortes possibilités que le gouvernement réforme prochainement le précompte immobilier (le cadastre n’est plus adapté) tandis qu’avec la régionalisation, le bonus habitation pourrait devenir moins intéressant.
Conclusion de M. Manceaux : "Cette baisse n’est pas une catastrophe. Si vous avez acheté en 2005 et que vous ne comptez pas revendre avant 2030, il n’y a vraiment aucun souci." Mais la stratégie d’investissement est en train de changer. "Prenons un jeune ménage qui se dit : 'On va acheter un petit appartement et dans cinq ou six ans - quand on aura des enfants - on achètera une maison.' Ce raisonnement n’est plus vraiment valable : ils risquent de se retrouver dans cet appartement plus longtemps que prévu."

Le bénéficiaire de votre assurance-vie est-il (toujours) le "bon"?


En cas de décès, le capital de votre assurance-vie reviendra-t-il bien à la personne que vous souhaitez? Compte tenu des aléas de la vie - divorces, séparations, familles recomposées -, rien n’est moins sûr. Vérifiez!


Souscrire une assurance sur la vie implique de désigner un ou plusieurs bénéficiaires qui percevront un capital (ou une rente) si vous veniez à décéder. Concrètement, le choix d’un bénéficiaire peut se faire de deux manières: soit vous désignez quelqu’un par son nom, soit vous citez le lien qui l’unit à vous ("mon conjoint", "ma belle-fille", etc.). Dans ce deuxième cas, le bénéficiaire de votre capital ne sera pas forcément le même que celui auquel vous songiez lorsque vous avez souscrit le contrat. 
Mais le premier cas de figure peut évidemment aussi poser problème. Car la roue tourne. Et les couples aussi!
Dans un pays où les assureurs-vie encaissent quelque 20 milliards d’euros et où l’on compte désormais plus d’un divorce pour deux mariages (1 sur 15 en 1960!), la question de la désignation du bénéficiaire n’a rien d’anecdotique.
Un exemple? Vous cohabitez légalement avec Isabelle, que vous désignez nommément comme bénéficiaire du capital de votre assurance-vie. Une dizaine d’années plus tard, vous avez quitté Isabelle et vous cohabitez désormais légalement avec Marianne. Si vous décédez et que vous n’aviez pas changé le nom de la bénéficiaire sur votre contrat, c’est à… Isabelle qu’ira le capital de votre assurance.
Autre exemple, mais avec vos enfants cette fois. Lors de la souscription de votre contrat, vous aviez un enfant, Pierre. Un autre est né par la suite, Yvan. Si vous aviez désigné comme bénéficiaires "mes enfants", Pierre et Yvan se partageront le capital. Mais si vous aviez simplement désigné "mon fils Pierre", car Yvan n’était pas encore né, ce dernier ne touchera rien du capital assuré. Vous avez donc intérêt à vérifier régulièrement la pertinence du choix du bénéficiaire de votre assurance-vie.
Dans le cadre d’une assurance-vie individuelle, souscrite à titre privé, vous disposez d’une totale liberté pour la désignation du bénéficiaire: un membre de la famille, un(e) ami(e), voire une association caritative. La liste des bénéficiaires ne sera plus restreinte que si vous souhaitez bénéficier d’un avantage fiscal. Vous pouvez modifier le bénéficiaire de votre assurance-vie (sauf clauses spéciales) quand vous le souhaitez.


L’assurance de groupe, cas particulier

Si votre assurance-vie a été souscrite par votre employeur (contrat collectif), commencez par vérifier ce que prévoit le règlement de pension. Le plus souvent, il prévoit une cascade de bénéficiaires, le premier étant généralement le conjoint ou le cohabitant légal, désigné de façon générique. Il faudra donc vérifier au moment du décès, qui a la qualité de conjoint. En effet, si une procédure de divorce avait été entamée, le conjoint ne sera plus bénéficiaire de ce capital en ce qui concerne l’assurance de groupe. Idem pour le cohabitant légal, lorsqu’il a été mis fin à la cohabitation selon la procédure légale.

Cela dit, le règlement de pension prévoit souvent mais pas toujours — la possibilité pour les affiliés de désigner nominativement une personne comme bénéficiaire du capital décès ou de déroger à l’ordre des bénéficiaires initialement prévu. La désignation nominative du conjoint faite pendant le mariage perdra donc sa validité dès le moment où le divorce est prononcé. Cette règle est d’application pour tous les divorces prononcés depuis le 1er septembre 2007.

Attention, si la désignation nominative a été faite avant le mariage, elle ne perdra pas automatiquement sa validité. Il faudra donc révoquer cette désignation bénéficiaire. En outre, si les époux conviennent de modalités spécifiques lors de leur divorce (par ex. dans leur convention de divorce), ils seront tenus de respecter ces engagements.

Si le règlement de l’assurance de groupe autorise l’affilié à désigner lui-même un bénéficiaire, et que rien n’a été prévu au profit de l’ex-époux ou épouse dans la convention de divorce, rien ne s’opposera à la désignation nominative d’une autre personne en tant que bénéficiaire, comme par exemple une nouvelle compagne.

Dans ce cas, cette dernière bénéficiera alors d’un droit propre qu’elle pourra exercer directement l’égard de l’assureur. En effet, le capital d’une assurance de groupe ne fait pas partie de la succession, il s’agit d’une stipulation pour autrui. Le capital décès revient donc au bénéficiaire à titre personnel, sans passer par le patrimoine de la succession et indépendamment d’une quelconque qualité d’héritier.

Gare aux héritiers réservataires

Attention: si le versement de l’assurance-vie (groupe ou individuelle) devait porter atteinte à la part des héritiers réservataires, parmi lesquels figurent les enfants de l’affilié, ces derniers pourraient réclamer la part successorale dont ils ne peuvent légalement être privés (la part réservataire).

Un exemple? Les deux enfants d’une personne non mariée ont chacun une part réservataire équivalente à un tiers de la succession. La partie (quotité) disponible de la succession se limite donc à un tiers. Tiers qui peut être donné ou légué à n’importe quelle autre personne.

Il arrive que les donations, les assurances-vie et les legs (via testament) réalisés par un défunt dépassent cette quotité disponible. Les héritiers réservataires qui sont dans ce cas privés d’une partie de ce qui leur est dû, peuvent alors demander que ces donations, assurances-vie ou legs soient réduits à la quotité disponible. Il s’agit d’une demande en "réduction" des libéralités excessives. Cette demande n’est pas automatique et seuls les héritiers réservataires peuvent la faire. Tout ce qui dépasse la quotité disponible et porte donc atteinte à la réserve devra alors être restitué…


Et en cas de suicide?

L’article 101 de la loi du 25 juin 1992 sur le contrat d’assurance terrestre prévoit que "sauf convention contraire, l’assurance ne couvre pas le suicide de l’assuré survenu moins d’un an après la prise d’effet du contrat. L’assurance couvre le suicide survenu un an ou plus d’un an après la prise d’effet du contrat. La preuve du suicide incombe à l’assureur."

Sauf disposition contraire dans le règlement de l’assurance-groupe, le suicide ne sera donc pas couvert pendant la première année d’affiliation. Le capital décès ne sera alors pas versé. Après la première année, ce risque n’est plus exclu. La totalité du capital décès sera donc versée même en cas de suicide.

C'est paradoxalement une mauvaise nouvelle pour les marchés : la situation de l'emploi se révèle meilleure que prévu aux Etats-Unis. Le rapport du département du Travail publié vendredi montre que l'économie américaine a créé 195.000 emplois (lire page 6). Résultat : les places européennes ont terminé la journée dans le rouge. L'indice EuroStoxx 50 a cédé 1,91 % sur la séance, le CAC 40 a baissé de 1,46 % et le DAX allemand a chuté de 2,36 %. Aux Etats-Unis, Wall Street a gagné 0,98 %, à 15.135,84 points.

Au plus bas depuis juillet 2011

Le raisonnement des investisseurs est le suivant : si la situation de l'emploi s'améliore, la Réserve fédérale (Fed) n'hésitera pas à lever progressivement ses mesures d'assouplissement quantitatif. Cette perspective d'un resserrement plus rapide que prévu de la politique monétaire américaine a fait bondir les taux américains à 10 ans de plus de 20 points de base, à 2,739 % vendredi, du jamais-vu depuis 2011. Dans ce contexte, l'affaiblissement de l'euro par rapport au dollar a toutes les raisons de se poursuivre. En deux jours, la monnaie unique a perdu 1,39 %. Elle a terminé la semaine à 1,2833 dollar, son plus bas niveau depuis juillet 2011. De part et d'autre de l'Atlantique, les perspectives de croissance sont sans commune mesure. Surtout, les politiques monétaires ont pris des orientations totalement divergentes. Aux Etats-Unis, il est clair depuis plusieurs semaines que la Fed se prépare à modérer le rythme de ses achats de titres sur le marché, ce qui dope le dollar, puisque les actifs libellés dans la devise américaine vont progressivement offrir des rendements plus élevés. Facteur de soutien supplémentaire, à en croire les économistes de marché, le dernier rapport sur l'emploi accroît la probabilité que la diminution graduelle des injections de liquidité de la Fed débute dès septembre. Certains économistes, comme ceux de Goldman Sachs et de JPMorgan Chase, qui tablaient jusque-là sur décembre, ont d'ailleurs revu leur calendrier.
Quant à l'euro, il est depuis jeudi dernier équipé d'une ceinture de plomb. En s'engageant à maintenir « pour une période prolongée » sa politique de taux bas et en laissant la porte ouverte à de nouveaux assouplissements, la Banque centrale européenne a immédiatement fait réagir les cambistes. Vendredi, le Finlandais Erkki Liikanen, membre du Conseil des gouverneurs de la BCE, a à son tour insisté sur l'indépendance de la politique monétaire européenne par rapport à celle de la Fed.
Jusqu'où la monnaie unique peut-elle baisser ? Nombre de stratèges ont revu leurs prévisions à la baisse. « Maintenant que les taux de la zone euro sont solidement ancrés, l'élargissement du différentiel de taux [avec les Etats-Unis] et les données économiques américaines vont affaiblir l'euro », avance l'équipe d'ING, qui table sur un niveau de 1,20 dollar pour la devise européenne en fin d'année. A plus court terme, « si l'euro parvient à casser le seuil de 1,2750-1,2850, il pourrait rapidement se diriger vers 1,24 dollar », prévoient les analystes.

Crédits hypothécaires: les taux remontent… mais pas pour tout le monde


Le taux de référence belge à 10 ans est brutalement passé de 2% à 3%. Si ces 100 points de base acquis depuis début mai ne semblent pas devoir se répercuter sur les des carnets d’épargne, sur les crédits hypothécaires, en revanche, la hausse se fait déjà ressentir… En particulier pour les échéances longues. 

La fin du crédit bon marché?




Est-ce la fin du crédit bon marché? Et faut-il encore profiter de cette fenêtre de tir avant que le crédit ne devienne vraiment plus cher? En tout cas pour ce banquier de la place bruxelloise, les taux des crédits hypothécaires sont indiscutablement repartis à la hausse. "Nous avons augmenté de 10 centimes vendredi, après 5 centimes la semaine passée, 10 centimes la semaine d’avant et 6 centimes la semaine précédente. Mais comme vous le savez, les banques lissent les variations de l’OLO. En fait, mon plus bas et quand je dis plus bas c’est depuis 60 ans - remonte à juin 2012: 2,82% pour le 15 ans fixe par exemple. Aujourd’hui, je suis à 3,20%, c’est-à-dire le niveau de fin 2011".

La vérité, c’est que les banques ont surtout mis à profit la baisse des taux précédente pour engranger des marges. "Cela se compte en dizaines de centimes, et toutes les banques l’ont fait".

Ceci posé, la hausse des tarifs ne touche pas toutes les catégories de prêt de la même façon. "Ceux qui en prennent plein la figure pour l’instant, ce sont indéniablement les prêts à long terme. Notre 30 ans fixe va passer à 4,35%, soit 1% de plus qu’en juin 2012!, reprend le banquier. C’est pour cela que nous conseillons beaucoup le semi-fixe. Pour le 10-5-5, on est à 2,94%, un très bon taux. Et d’ici 10 ans, nos clients verront bien ce qui se passera. Leur situation aura évolué, ils pourront peut-être racheter leur prêt…"

De fait, les banques n’aiment pas prêter à long terme à un taux fixe, car "elles calculent leur rentabilité sur 7 ans, explique John Romain, d’ImmothekerMaintenant que les taux sont très bas et qu’ils ne peuvent donc que remonter, elles veulent se couvrir et préfèrent pousser leurs clients vers des échéances plus courtes ou du semi-fixe. Mais il faut quand même faire attention à votre budget: même si c’est dans dix ans, serez-vous capable de soutenir une hausse du taux?".

Yves Evenepoel, de Test-Achats, appelle aussi à la prudence concernant les taux variables. "N’oubliez pas que ce sont les taux variables aux Etats-Unis qui sont à l’origine de la crise. Même si les prêts hypothécaires sont encadrés par la loi en Belgique, on peut doubler les intérêts exigés et, pour peu que les salaires n’augmentent pas beaucoup parce que la crise persiste et parce qu’il y a peu d’inflation, un couple peut se retrouver en difficulté à la première révision, même si c’est après 10 ans. Les enfants qui grandissent, ce sont aussi les charges du couple qui augmentent".

En réalité, "seules les compagnies d’assurances peuvent encore offrir des taux intéressants à long terme, car leur funding est puisé dans la branche 21, et non dans les carnets d’épargne. Vous pourrez trouver du 30 ans fixe à 3,95% contre 4,74% chez les banques. Mais il y a peu d’assureurs sur le marché et ils n’affectent que peu de moyen au crédit hypothécaire: 100 ou 150 millions d’euros tout au plus", poursuit John Romain.

Selon les moyennes compilées par immotheker.be, depuis le plus bas de l’OLO touché le 8 mai (1,97%), le 25 ans fixe (avec conditions) est passé de 3,67% à 3,91% (+0,24%) alors que le 20 ans fixe n’a dans le même temps augmenté que de 0,20% à 3,75% et le 15 ans fixe, de 0,15% à 3,45%.

Une hausse marquée certes, mais qui reste donc relativement modeste: au pire, les banques n’ont répercuté qu’un quart environ de la hausse de l’OLO jusqu’à présent.

Et concentrée sur les échéances longues, avec une différence de 0,40% entre le 25 ans fixe et le 30 ans fixe.

Yves Evenepoel tempère: "Vous pouvez trouver du 30 ans fixe à 3,95% aujourd’hui contre 3,70% en juillet 2012. Et en moyenne, les taux que nous répertorions sont en hausse de 0,20%. Donc oui, ça monte, mais les taux sont encore extrêmement bas dans une perspective historique".


Les profils qui rient et ceux qui pleurent


Le profil des emprunteurs a-t-il changé ? "Beaucoup, s’étonne notre banquier bruxellois.Je n’ai pratiquement plus de jeune qui vient acheter son premier logement. Avant j’avais 2 logements pour 1 investissement. Aujourd’hui c’est l’inverse car les gens qui ont un peu d’argent ne savent plus où le placer. J’ai aussi énormément de Français qui achètent des maisons à prix d’or du côté du Châtelain. Et ce ne sont plus des exilés fiscaux pur jus qui viennent avec leur magot, mais plutôt des entrepreneurs qui créent de l’emploi et qui déménagent en Belgique". Et qui empruntent donc.

Quant au "petit jeune", on peut dire qu’il est carrément mis sur la touche. "Depuis février, on ne peut plus prêter pour les frais de notaire, ce que nous faisions régulièrement avant, par exemple via un prêt à tempérament. Même si le profil et le revenu sont excellents, on ne peut plus l’accorder. BNP Paribas est plus strict encore: pas de prêt de plus de 15 ans pour une maison de rapport. Et, pour un logement, il doit rester 1.250 euros dans la poche de l’emprunteur, ce qui est très difficile pour nombre d’entre eux".

Une tendance que confirme immotheker.be. "Oui, les conditions sont encore plus strictes. Emprunter 100% de la somme est de plus en plus un problème. Ou alors il faut des garanties sur 10 ou 15% du montant".

Les "investisseurs", s’ils sont peut-être plus nombreux dans (les beaux quartiers de) la capitale, ne constitueraient toutefois que 15% des dossiers des prêts à l’échelle nationale.

Et la formule ne convient d’ailleurs pas forcément à toutes les catégories d’âge. "Vous savez, il y a des gens de 55 ou 60 ans qui viennent me trouver pour un investissement. Mais ils doivent bien se rendre compte qu’avec 15% de frais de notaire, il faut 3% de plus-value par an pour amortir ces frais sur 5 ans. Si la plus-value n’est pas au rendez-vous et que la situation économique se dégrade, gare aux mauvaises surprises... Et puis il faut bien penser au coût que représente un investissement immobilier lors d’une succession, si on se place d’un point de vue patrimoine familial global", pointe John Romain.

Est-il devenu plus difficile de négocier son prêt ? "Pas du tout, on négocie toujours aussi facilement… mais quand on est en position de le faire. Ce qui a changé c’est l’appréciation du risque par les banques", selon le banquier. "Depuis la crise, les banques ont très fort segmenté le marché: il n’était plus possible d’accorder les mêmes prêts à tout le monde, explique John Romain. Mais sous les taux plancher, il y a toujours les taux cave dont jouissent 6% des acheteurs parce que toute leur famille a du bien dans la même banque. Pour eux, rien n’a changé: si l’an passé ils avaient droit à du 3,50%, aujourd’hui ils ont toujours du 3,50%". Quant à la position officielle des banques belges sur les prêts hypothécaires, elle ne nous apprend strictement rien si ce n’est qu’elles "suivent de près l’évolution des taux".


Pression sur les prix ?


Selon les études, une hausse de 1% des taux des prêts hypothécaires entraînerait une baisse de… 5 à 7% des prix des habitations. Voilà qui, en théorie du moins, devrait exercer une sérieuse pression sur les prix de ce marché belge qui a pourtant l’air de résister à toutes les "intempéries". Mais d’une part la corrélation avec l’évolution de l’OL0 n’est pas si forte qu’on ne pourrait le penser et, en outre, "on ne va pas voir cette force s’exercer tout de suite car il y a assez de funding dans le pays. Il y a bien un peu de fonds qui s’en vont aux Pays-Bas via Rabobank ou en France via BNP Paribas mais les carnets croulent toujours sous l’épargne des Belges et ceux-ci sont parvenus à maintenir leur taux d’épargne au niveau exceptionnel de 15,50% de leurs revenus disponibles", relève John Romain.
